Out of all the US states, California had the largest number of Native Americans residing there than any other state. In fact, there were more than five hundred different recorded groups or sub-tribes which had diverse cultural beliefs and forms of leadership. Some debatable archeological evidence shows signs of human habitation here nearly 19,000 years ago, but most archeologists agree there is widespread evidence of hunter-gatherers cultures in the area dating back to around at least 11,000 years ago. The tribes that were recorded here around the time of European contact typically fell into one of seven different language families which included the Yuki-Wappo, Uto-Aztecan, Penutian, Chumashan, Algic, Hokan, and Athabaskan.

The Spanish were the first Europeans to explore this area starting in 1542 under the leadership of Juan Rodriguez Cabrillo. Francis Drake, a Briton, later arrived in 1579 and laid claim on some parts of the coast. In 1602, Sebastian Vizcaino drew the map of the shores of this state and placed it under New Spain. The Spanish continued to dominate this region which saw their missionaries establish various mission centers while the soldiers built forts. Small towns were also founded and would later develop to become big cities like San Jose and Los Angeles. The Russians explored this area and established a trading post at Fort Ross. The Francisco Bay was the southernmost part of the Russian Colony. When the Spanish lost their control of this area through the Mexican War of Independence in 1821, the region became part of a vast northern province of the country of Mexico named as Alta California. This region remained under the administration of Mexican government for 25 years until they turned it over to the USA upon the signing of the Treaty of Guadalupe after Mexico lost the Mexican-American War in 1848.

With an estimated population of about 92,000 people, California was admitted to the Union on September 9, 1850, as the 31st state. It covers an area of about 163,169 square miles which makes it the 3rd largest state in area in the country. Calif. is US’s most populous state with an estimated population of nearly 40 million people. Nicknamed the Golden State, Gold and Blue are the official colors of this state which is guided by the motto Eureka.

The state is located on the western side of the United States and borders the states of Arizona, Nevada, and Oregon as well as having a nearly 900 mile long border with the Pacific Ocean and the country of Mexico. Since the state is very large, its terrain includes many differnt things like cliff-lined beaches, redwood forest, and the Mojave Desert. The state can be categorized into two key regions; Southern and Northern. In the middle part is the Central Valley known for its fertile soil that supports many agricultural activities. The Sierra Nevada mountain ranges are on the eastern side of this valley while the Cascade Ranges are on the upper side. Near the ocean, there are the Pacific Coast Ranges while the Tehachapi Mountains are in the lower part. This state gets most of its water supply from the Sacramento-San Joaquin River Delta.

Most parts of the State experience a Mediterranean climate, but due to its large size the climate also ranges from subtropical to subarctic. Near the coast, there is summer fog while further inland there are hotter summers and colder winters. San Francisco and Los Angeles enjoy a microclimate of cooler temperatures in the summer due to maritime moderation compared to most metropolitan areas in the US of the same latitude. The north receives more rainfall than the south due to the mountain ranges that also influence the climate. The Central Valley and Northwestern part has Mediterranean and temperate climate respectively. On the eastern side, the mountains produce rain shadows creating extensive deserts.

This state has various monuments, national trails, and parks. For instance, the CA National Historic Trail is part of a trail cutting across ten states used by more than 250,000 emigrants during the biggest mass migration in America’s history arising from the infamous Calif. Gold Rush of 1849. The Channel Islands National Park is a preserve for a total of 5 islands and their immediate surroundings which are known for their unique wildlife and plants. The Lassen Volcanic National Park is known for its volcanoes, clear mountain lakes, wildflowers, and steaming fumaroles. Other major attractions include; Yosemite, the Mojave National Preserve, the Death Valley National Park, the Muir Woods National Preserve, the Pony Express National Historic Trail, the Joshua Tree National Park, Alcatraz and the Golden Gate Bridge in San Francisco, the Point Lobos State Reserve in Carmel, the Palm Springs Aerial Tramway in Palm Springs, the La Jolla Kayak, the Marin Headlands, the scenic Pacific Coast Highway - Route 1, the Sequoia and Kings Canyon National Park with its massive Redwoods near Visalia, the Torrey Pines State Natural Reserve, Coronado Island, Elephant Seal Rookery in San Simeon, Balboa Park in San Diego, and Rosie the Riveter World War II Home Front National Park in Richmond. The city of Sacramento serves as the capital of the state. This town is known by several nicknames such as; Sactown, the City of Trees, Sac-a-Tomatoes, Sacto, and Sac. The city also acts as a major transportation hub served by the Sacramento International Airport and several major highways such as I-80 passing through it. Sacramento is known for its preservation of local culture and arts with facilities such as the Eagle Theater not forgetting that the Southern and Central Pacific Railroads were both founded here.

Residents here have access to some fantastic universities. The Cal State University has been the largest public university system in the country with over 430,000 students and has campuses in cities such as Bakersfield, Channel Islands, Chico, Dominguez Hills, East Bay, Fresno, Fullerton, Humboldt, Long Beach, Los Angeles, Monterey Bay, Northridge, Pomona, Sacramento, San Diego, San Francisco, San Jose, Rohnert Park, San Luis Obispo, San Marcos, Maritime, Sonoma, and Stanislaus. UC is another big university system with their larger campuses in Berkeley, Los Angeles, San Diego, Irvine, Davis, Santa Barbara, Merced, Santa Cruz, Riverside, and San Francisco. When buying or selling a house here, the real estate closing agent will typically use a Grant Deed to convey the title of the property to the new owner. For the deed to be legally valid, it must have the property’s exact legal description within the document. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying real estate. Calif. has three main initial starting points for their PLSS which include the Humboldt Meridian, the San Bernardino Meridian, and the Mount Diablo Meridian. Because this area used to be controlled by Spain and Mexico, some of the earlier platted land still uses the old survey system of Ranchos from the original Spanish and Mexican Land Grants.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust. Another less conventional method in CA is for the bank to use a Mortgage instead.

If for some reason the borrower cannot repay the home loan, then the lender who used the Deed of Trust method can save time and money and avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 117 days to complete. However, if a Mortgage were used, then the lender would need to go through the court system and start a more lengthy and costly judicial foreclosure instead.

The laws that pertain to the foreclosure process here are mostly found in Calif. Civil Code, Section 2924. However, if you are a landlord here that needs to evict a non-paying tenant, then you would need to reference the statutes of CCC §§ 1925-1954, §§ 1961-1962.7 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the CA Bureau of Real Estate, which oversees all the licensing of the agents and most of the implementation and enforcement of the California Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete three specific real estate courses, successfully pass the written real estate state exam, pass some criminal background checks, and pay the various required licensing fee.
