Out of all the US states, California had the largest number of Native Americans residing there than any other state. In fact, there were more than five hundred different recorded groups or sub-tribes which had diverse cultural beliefs and forms of leadership. In 1602, Sebastian Vizcaino drew the map of the shores of this state and placed it under New Spain. The Spanish continued to dominate this region which saw their missionaries establish various mission centers while the soldiers built forts. Small towns were also founded and would later develop to become big cities like San Jose and Los Angeles. The Russians explored this area and established a trading post at Fort Ross. The Francisco Bay was the southernmost part of the Russian Colony. When the Spanish lost their control of this area through the Mexican War of Independence in 1821, the region became part of a vast northern province of the country of Mexico named as Alta California. This region remained under the administration of Mexican government for 25 years until they turned it over to the USA upon the signing of the Treaty of Guadalupe after Mexico lost the Mexican-American War in 1848.
With an estimated population of about 92,000 people, California was admitted to the Union on September 9, 1850, as the 31st state. It covers an area of about 163,169 square miles which makes it the 3rd largest state in area in the country. Calif. is US’s most populous state with an estimated population of nearly 40 million people. Nicknamed the Golden State, Gold and Blue are the official colors of this state which is guided by the motto Eureka.
The state is located on the western side of the United States and borders the states of Arizona, Nevada, and Oregon as well as the Pacific Ocean and the country of Mexico. When buying or selling a house in California, the real estate closing agent will typically use a Grant Deed to convey the title of the property to the new owner. For the deed to be legally valid, it must have the property’s exact legal description within the document. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying real estate. Calif. has three main initial starting points for their PLSS which include the Humboldt Meridian, the San Bernardino Meridian, and the Mount Diablo Meridian. Because this area used to be controlled by Spain and Mexico, some of the earlier platted land still uses the old survey system of Ranchos from the original Spanish and Mexican Land Grants.
If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust. Another less conventional method in CA is for the bank to use a Mortgage instead.
If for some reason the borrower cannot repay the home loan, then the lender who used the Deed of Trust method can save time and money and avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 117 days to complete. However, if a Mortgage were used, then the lender would need to go through the court system and start a more lengthy and costly judicial foreclosure instead.
The laws that pertain to the foreclosure process here are mostly found in Calif. Civil Code, Section 2924. However, if you are a Californian landlord that needs to evict a non-paying tenant, then you would need to reference the statutes of CCC §§ 1925-1954, §§ 1961-1962.7 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the CA Bureau of Real Estate, which oversees all the licensing of the agents and most of the implementation and enforcement of the California Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete three specific real estate courses, successfully pass the written real estate state exam, pass some criminal background checks, and pay the various required licensing fee.
