The modern-day state of Colorado was perhaps first inhabited by Paleo-Indians about 15,000 years ago as suggested by the artifacts discovered at the Lindenmeier Archeological Site. Some of the later recorded contemporary Native American tribes in this area around the time of the European expeditions were; the Pueblo people who inhabited the area around the Colorado Plateau, the Ute Nation, who lived in the highlands, while the Comanche and Apache were typically found in the lower and eastern parts of this state. Other notable groups who visited this area primarily in hunting expeditions were the Cheyenne and Arapaho nations.
The Spaniard Juan de Onate was the earliest known European to arrive in this area in the late 16th century. Juan de Ulibarri laid claim on much of the southwestern part in 1706 which later became part of the Province of Nuevo Mexico. The northeastern part of the territory, however, was initially controlled by France and then later acquired by the USA through the Louisiana Purchase of 1803. Mexico’s defeat in the Mexican-American War in 1848 and their ceding to the United States a vast track of land in the modern-day southwestern part of the USA was the final piece of paving the way for the Territory of Colorado to be created on February 28, 1861. This territory was named after the Colorado River, and its original boundaries drafted during its creation are still used to this day.
Colorado was admitted to the union as the 38th state with an estimated population of about 190,000 people on August 1, 1876. When buying or selling a house in Colorado, the real estate closing agent will typically use a Warranty Deed, Special Warranty Deed, Bargain and Sale Deed, or Quit Claim Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. The Centennial State primarily follows the Public Land Survey System (PLSS) methodology when surveying real estate. They use three initial starting points for their PLSS in this state which are the Ute Meridian, the New Mexico Principal Meridian, and the Sixth Principal Meridian.
If you aren’t paying cash for the home and are instead getting a loan to buy the piece of real estate, then understand that this is primarily a title theory state here. This simply means that the raw title of the property will remain in a trust and held by a trustee until the lien is completely paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust or a Trust Deed.
If for some reason the borrower cannot repay the loan, then the lender can save time and money and avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 145 days to complete.
The laws that pertain to the foreclosure process here are in the C.R.S. of Title 38 and Articles 37, 38, and 39. However, if you are a Coloradoan landlord that needs to evict a non-paying tenant, then you would need to reference Title 38, Article 12, Part I and III instead. Whereas if you are looking to become a real estate broker, then you would just deal directly with the CO Division of Real Estate, which oversees all the licensing of the agents and most of the implementation and enforcement of the Colorado Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 168 hours of their approved real estate courses, successfully pass state real estate licensing exams, pass some criminal background checks, and pay the various required licensing fee.
The rich culture, diverse economy, fantastic parks, modern education system, preservative museums and the beautiful terrain are just a few reasons why so many Coloradans like calling Colorado home. Speaking of homes, if you happen to have one that you would like to sell, then we would be honored with the opportunity to purchase it from you. If the speed of selling your home is your concern, have no fear because we can close escrow very quickly. In fact, if you had only contacted Finally Sold ten days ago, your home could have already been Finally SOLD by now.
