The present-day state of Delaware was inhabited by various Algonquian-speaking Native American tribes long before the European encounter. The Delaware people were hunters and gatherers that occupied the area around the Delaware Valley while the Nanticoke settled around the Chesapeake Bay. The Iroquois attacked the Delaware people in the 1670’s causing most of them to relocate to the Alleghany Mountains in the mid-18th century.

The 1st Europeans to land in this area were the Dutch and by 1631 they had founded a trading post at the Zwaanendael. The Swedish established Fort Christina in 1638 and named their colony New Sweden, but it was short lived and only lasted for seventeen years. The Dutch then annexed that Swiss area and made it part of the New Netherland. The Dutch, however, also lost control of this land when they were attacked by the British in 1644 under the leadership of Sir Robert Carl and the area was placed in the Province of Pennsylvania. This territory was in good terms with the British colonizers as they engaged in fruitful trade and thus were reluctant to participate in the American Revolution War. However, on June 15, 1776, Delawareans became defiant and through a popular vote proclaimed their independence from both the Province of Pennsylvania and the British rule.

Delaware became a state on December 7, 1787, with an estimated population of about 40,000 people and was the very 1st state in what would become the United States. It covers an area of 1,982 square miles making it the country’s 2nd smallest state in land area. With an estimated one million Delawareans calling it home, it now ranks as the 45th most populous US state. Liberty and Independence is the motto of this state which has been dubbed; the Diamond State, the First State, the Blue Hen State, and the Small Wonder.

Del. is located on the east coast of the United States and is considered one of the Mid-Atlantic States. Its immediate neighbors are the states of; Maryland, New Jersey, and Pennsylvania as well as Delaware Bay and the Delaware River on its eastern side. This state is situated on a level plain and is known to have the least mean elevation in the state. Some of the major regions include the Piedmont Plateau on the northern side which features rolling surfaces and hills. UD is the largest public university in this state and has its main campus in the city of Newark and several campuses in the towns of Lewes, Dover, Georgetown and Wilmington. DSU is another public university with its main campus in Dover. The biggest private university is Wilm U with enrollment of nearly 15,000 students.

Despite its small size and population, the Blue Hen State hosts several professional teams that play in various minor leagues. Some of them include the Del. 87ers which are affiliates with the NBA Philadelphia 76ers basketball team, the USA Rugby League's Delaware Black Foxes, and the Wilm. Blue Rocks with the MLB Kansas City Royals baseball team. College level sports also have a wide following with the most notable teams being the Fightin’ Blue Hens and the DSU Hornets. This state is known for holding various NASCAR races at the Dover International Speedway.

The state’s economy is diversified and receives contributions from sectors such as agriculture, education, food processing, banking, manufacturing, insurance, finance, and transport just to mention a few. When buying or selling a house in Delaware, the real estate closing agent will typically use a Special Warranty Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. Since this state used to be part of the original 13 U.S. Colonies, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a lien theory state. This just means that the raw title of the property will remain as collateral until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Mortgage.

If for some reason the borrower cannot repay the home loan, then the lender must go to court and start a judicial foreclosure which typically takes about 170 to 210 days to complete so long as it remains uncontested. During this process, the mortgage company’s attorney will also typically file a lis pendens against the property so that the public is made aware of the pending foreclosure via a procedure which is known as scire facias. The property is then sold as part of a publicly noticed sale. Once the judge rules in favor of the mortgage company, then the court will issue a final judgment of foreclosure and the property will either revert back to the bank or will be awarded to the highest bidder at the foreclosure auction. The laws that pertain to the Del. foreclosure process are mostly found in DE Code: Title 10, Part III, Chapter 49, Subchapter XI.

However, if you are a Delawarean landlord that needs to evict a non-paying tenant, then you would need to reference Title 25 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the DE Real Estate Commission, which oversees all the licensing of the agents and most of the implementation and enforcement of the Delaware Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 99 hours of thier approved real estate courses, successfully pass the written real estate state exam, pass certain criminal background checks, and pay the various required licensing fees.
