Before the arrival of the European Explorers, Minnesota was primarily inhabited by the Dakota. Later, the Chippewa Indians inhabited arrived in the area, and this caused tension among the Dakota. The natives in this area primarily engaged in farming as well as hunting and gathering. They also settled into distinct neighborhoods and were organized into clans.

The French explorers were the earliest to land in this area and were later followed by the Spanish. For quite some time, this state fell under both the French and Spanish rule, and the borders were not clearly defined. Its path to US ownership came in two stages with the part east of the Mississippi River being acquired from the British, through winning the American Revolutionary War in 1783. The region west of the Mississippi was later peacefully purchased by the USA from the French via the Louisiana Purchase in 1803. With an estimated population of about 170,000, Minnesota was admitted to the Union on May 11, 1858, people making it the 32nd state. The state is located in the Midwestern part of the United States and shares its borders with the states of Michigan, North Dakota, Wisconsin, Iowa, South Dakota and the country of Canada as well as Lake Superior. When buying or selling a house here, the real estate closing agent will typically use a Warranty Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying the properties. The initial starting point for their PLSS is the Fourth Principal Extended Meridian which uses lines originating from the Illinois-Wisconsin borders.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Mortgage.

If for some reason the borrower cannot repay the home loan, then the lender can typically avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 90-100 days to complete. However, when necessary, the lender may need to instead go to court and start a more lengthy and costly judicial foreclosure. The laws that pertain to the Minn. foreclosure process are mostly found in MN Statutes in Chapter 580.01 et. seq..

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the Minn. statutes of Chapter 504B instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the Minn. Department of Commerce, which oversees all the licensing of the agents and most of the implementation and enforcement of the Minnesota Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete 3 MN real estate pre-licensing courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed MN real estate broker, and pay the various required licensing fees.
