The modern-day state of Maryland was first inhabited by the Paleo-Indians who engaged in hunting and gathering at least as early as 12,000 years ago. By 1000 BC, several Algonquian tribes were living here and were spread across different villages. With an estimated population of about 300,000 people, Maryland was admitted to the Union on April 28, 1788, making it the 7th state. It covers an area of 12,407 square miles which makes it the 42nd largest state in land mass. With the more than 6 million Marylanders calling Maryland home, it now ranks as the 19th most populous US state. It is known by various nicknames such as; the Little America or America in Miniature and is driven by the motto; Strong Deeds, Gentle Words. Black, Gold, White and Red are the official colors of this state.

The state of Maryland is located in the central part of the United States; specifically, the Mid-Atlantic region which is made up of states in between the South Atlantic and New England states. Md. shares its borders with the city of Washington D.C., Atlantic Ocean and the states of West Virginia, Pennsylvania, Delaware and Virginia. When buying or selling a house in Maryland, the real estate closing agent will typically use a Grant Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. Since this state used to be part of the original 13 U.S. Colonies, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this state is primarily a lien theory state. This just means that the raw title of the property will remain as collateral until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust.

If for some reason the borrower cannot repay the home loan, then the lender must go to court and start a judicial foreclosure which typically takes about 46 days to complete so long as it remains uncontested. During this process, the mortgage company’s attorney will also typically file a lis pendens against the property so that the public is made aware of the pending foreclosure. Once the judge rules in favor of the mortgage company, then the court will issue a final judgment of foreclosure and the property will either revert back to the bank or will be awarded to the highest bidder at the foreclosure auction. The laws that pertain to the foreclosure process here are mostly found in Maryland Rules, Title 14, Chapter 200.

However, if you are an Marylander landlord that needs to evict a non-paying tenant, then you would need to reference the statutes of Real Property Article, Title 8 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the Maryland Real Estate Commission, which oversees all the licensing of the agents and most of the implementation and enforcement of the Maryland Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 60 hours of their approved real estate courses, successfully pass the written state real estate exam, pass certain criminal background checks, and pay the various required licensing fees.
