Before the Europeans arrival, Michigan was primarily inhabited by the Native American Algonquian people which included the Chippewa, Ottawa, and Potawatomi tribes who had collectively formed a confederation known as the Council of Three Fires which was tasked with the administration of the area for peaceful coexistence. The French saw the need to protect their territory from British invasion and thus built Fort Pontchartrain. The settlement around this fort became an important trading post for fur and also a shipping post. Michigan was included in the Royal Provinces of New France until the French lost to the British in the French and Indian War in 1763. It was later ceded to the USA via the Treaty of Paris of 1783, which marked the end of the American Revolutionary War.

Initially, the US placed the area in the Northwest Territory. However, in 1800 Western Michigan became a part of the Indiana Territory. Then, in 1805, the Michigan Territory was created, and that lasted until Michigan was admitted to the Union on January 26, 1837, making it the 26th state. It currently covers an area of 96,716 square miles which makes it the country’s 11th largest state in land mass. With the nearly 10 million Michiganians calling Michigan home, it now ranks as the 10th most populous US state. The motto of this state is ‘If you seek a pleasant peninsula, look about you’, and has been nicknamed the Water Wonderland, the Great Lake State, and the Mitten State.

Michigan is located in the Midwestern part of the United States and borders the states of; Wisconsin, Indiana, Minnesota, Ohio, and Illinois as well as the country of Canada. MI falls under the Great Lakes region and actually borders four of the Great Lakes; Lake Erie, Lake Superior, Lake Michigan, and Lake Huron. This state is divided into the Upper Peninsula and Lower Peninsula, which is connected by the 5-mile long Mackinac Island Bridge. When buying or selling a house in Michigan, the real estate closing agent will typically use a Warranty Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying the properties. The initial starting point for their PLSS is the Michigan Meridian which begins at the Sault Ste. Marie. Because Michigan used to have French settlements prior to the use of PLSS adopted in 1815, the other surveying method used here is based on the old French survey system of "long lots".

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust or a Trust Mortgage.

If for some reason the borrower cannot repay the home loan, then the lender can typically avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 60 days to complete. However, when necessary, the lender may need to instead go to court and start a more lengthy and costly judicial foreclosure. The laws that pertain to the Mich. foreclosure process are mostly found in Chapter 451 of Michigan Compiled Laws.

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the Mich. statutes of Chapter 554, Act 348 of 1972 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the Michigan State Board of Real Estate Brokers and Salespersons, which oversees all the licensing of the agents and most of the implementation and enforcement of the Michigan Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 90 hours of approved MI real estate courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed Mich. real estate broker, and pay the various required licensing fees.
