Before the arrival of the Europeans, the Pennacook and Abenaki Native American tribes were the primary inhabitants of the area that developed to become the present-day state of New Hampshire. With an estimated population of about 140,000 people, New Hampshire was admitted to the Union on June 21, 1788, making it the 9th state. It covers an area of 9,349 square miles making it the 46th largest state in land area. With the nearly 1.5 million New Hampshirites that call New Hampshire home, it is ranked as the 46th most populous US state. This state, nicknamed The Granite State, uses the Motto; Live Free or Die and uses Yellow, Red, and Orange as its official colors.

The state of New Hampshire is located in the northeastern part of the United States and borders the state of Maine, Massachusetts, Vermont, the country of Canada and the Atlantic Ocean as well. N.H. resides in New England which occupies the Northeastern region of the U.S. This state is divided into several parts which include; the Great North Woods on its northern side which is a major tourist attraction. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying the properties. Since this state used to be part of the original 13 U.S. Colonies, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Mortgage.

They do this by merely starting a non-judicial foreclosure which typically only takes about 60 days to complete. However, when necessary, the lender may need to instead go to court and start a more lengthy and costly judicial foreclosure. The laws that pertain to the N.H. foreclosure process are mostly found in Title 38 New Hampshire Revised Statutes, Chapter 479.

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the N.H. statutes of  Title LV, Chapter 540 and  Title LV, Chapter 540-A instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the N.H. Real Estate Commission, which oversees all the licensing of the agents and most of the implementation and enforcement of the New Hampshire Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 40 hours of approved NH real estate courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed N.H. real estate broker, and pay the various required licensing fees.
