Before the arrival of the Europeans, the primary inhabitants of modern-day New York were the Native American Tribes of the Lenape and the Iroquois which included; the Onondaga, Mohawk, Tuscarora, Cayuga, Oneida and Seneca Tribes. The Third Anglo-Dutch War saw this province briefly recaptured by the Dutch in 1673 only for them to lose control of it again in 1674 to the British. The group known as Sons of Liberty was organized in this colony to oppose the oppressive taxes levied by the British Monarchy. Delegates from this Colony never voted during the United States declaration of independence as they were prohibited from doing so. However, New York was still one of the most important original 13 colonies. So much so, that during the revolutionary war, about one-third of all the battles took place in New York.

With an estimated population of about 330,000 people, New York was admitted to the Union as the country’s 11th state on July 26, 1788. It is ranked 27th based on land area as it covers 54,555 square miles. With the nearly 20 million New Yorkers that call New York home, it is ranked as the 4th most populous US state. This state is nicknamed the Empire State and thrives on the motto which says ‘Ever Upward.' Gold and Blue are its official colors.

N.Y. is located in the northeastern part of the United States with its immediate neighbors being the states of New Jersey, Massachusetts, Connecticut, Vermont and Pennsylvania as well as the Atlantic Ocean and the country of Canada. When buying or selling a house in New York, the real estate closing agent will typically use a Bargain and Sale Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying the properties. Since this state used to be part of the original 13 U.S. Colonies, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this state is primarily a lien theory state. This just means that the raw title of the property will remain as collateral until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Mortgage.

If for some reason the borrower cannot repay the home loan, then the lender must go to court and start a judicial foreclosure which typically takes about 445 days to complete so long as it remains uncontested. During this process, the mortgage company’s attorney will also typically file a lis pendens against the property so that the public is made aware of the pending foreclosure. Once the judge rules in favor of the mortgage company, then the court will issue a final judgment of foreclosure and the property will either revert back to the bank or will be awarded to the highest bidder at the foreclosure auction. The laws that pertain to the foreclosure process here are mostly found in New York State Consolidated Laws, Article 13.

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the N.Y. statutes of RPP: Real Property - Article 7: Landlord and Tenant instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the Division of Licensing Services, which oversees all the licensing of the agents and most of the implementation and enforcement of the New York Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 75 hours of approved NY real estate courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed N.Y. real estate broker, and pay the various required licensing fees.
