Did you know that Tennessee is an old Cherokee name? The state was named after a Cherokee village called Tanasi, and the word Tanasi actually means river - a suitable name for a state which is so famous for its river. The area was known as the Southwest Territory before it joined the Union June 1 1796. Its nickname is the Volunteer State, and that may have something to with the fact that it provided more soldiers for both the Union and Confederate armies than any state. Today, the state is famous for its vibrant music scene in both Nashville and Memphis, and no visit to the state is complete without taking in the music scene. Population wise, its ranked the 17th with a population of 6,600,299 over 424,143 square miles. This makes the state the 36th largest state.

Located in the southern region of the United States, the state shares its borders with several U.S. states like Kentucky, North Carolina, Virginia, Georgia, Alabama, Mississippi, Arkansas, and Missouri. It has 95 counties, and Shelby County is the most populous county in the state. The state capital Nashville is located in Davidson County, and the oldest county in the state is Washington county which was founded in 1777. Chattanooga and Knoxville are two other major population centers here and boost a joint population of 358,303. This is not really a winter state. The winters are in general mild, but at higher elevations such as the Appalachians mountains, the winters can be cool. Summertime can see temperatures around 90 Fahrenheit which makes the overall summer climate very pleasant.

This is not a state that is short of education facilities. In Knoxville, you will find the UT with an average enrollment of 27,000 students. It is a Flagship university with a strong focus on research programs. The University of Memphis also has well-known research programs, and along with MTSU In Murfreesboro, it has a Masters and Doctoral program. The town of Cookeville hosts TN Tech with its extensive Master's program and technical research facility.

Outdoor activities are popular, and this is a great state if you are a hiker. However, if you enjoy professional sports, this is the state for you as well. This is a state with a strong focus on sports, and anyone keen sports person can pursue a most any sports such as football to basketball to soccer to ice hockey. The Titans are members of the National Football League, and the Memphis Grizzlies are a team in the NBA. When buying or selling a house here, the real estate closing agent will typically use a Warranty Deed, Quitclaim Deed or Special Warranty Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. Since this state was around during the early years of the founding of America, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust.

If for some reason the borrower cannot repay the home loan, then the lender can typically avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 90 to 120 days to complete. However, when necessary, the lender may need to instead go to court and start a more lengthy and costly judicial foreclosure. The laws that pertain to the Tenn. foreclosure process are mostly found in TN Statutes in Chapter 21 Part 8 §21-1-803.

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the Tenn. statutes of Title 66, Chapter 28 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the Tenn. Real Estate Commission, which oversees all the licensing of the agents and most of the implementation and enforcement of the Tennessee Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 60 hours of approved TN real estate courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed Tenn. real estate broker, and pay the various required licensing fees.
