Over 12,000 years ago, several Native American tribes started arriving in the present-day state of Virginia. One of the first recorded tribes were the Algonquian people who founded the village of Werowocomoco. Other tribes that would settle later included the Siouan, who inhabited the western region and the Meherrin and the Nottoway, who inhabited the northern and southern parts of the state.

Though the Spanish were the first Europeans to explore the land that would later become Virginia, it was the English who would wind up successfully settling the area. In 1583, Walter Raleigh was granted a charter by the then Queen Elizabeth I from England to establish a colony located to the north of Spain’s territory known as Spanish Florida. One year later, Walter sent his troop, and Virginia was founded. In 1606, the London Company was founded and incorporated. This company funded the development of ‘New Town’ in ancient Jamestown, which was the first permanent British settlement in the area. Though the settlers suffered several setbacks and engaged in wars such as the Anglo-Powhatan War, most of them still survived, and the settlements became permanent.

When buying or selling a house in Virginia, the real estate closing agent will typically use a Warranty Deed or Special Warranty Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying the properties. Since this state used to be part of the original 13 U.S. Colonies, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Deed of Trust.

If for some reason the borrower cannot repay the home loan, then the lender can typically avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 45 days to complete. However, when necessary, the lender may need to instead go to court and start a more lengthy and costly judicial foreclosure. The laws that pertain to the Va. foreclosure process are mostly found in VA Statutes in Title 55, Chapter 4, §55-48 through §55-79.06.

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the Va. statutes of Title 55, Chapters 13.1-13.3 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the Va. Real Estate Board, which oversees all the licensing of the agents and most of the implementation and enforcement of the Virginia Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 60 hours of approved VA real estate courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed Va. real estate broker, and pay the various required licensing fees.

The beautiful scenery, rich history and culture, great beaches, strong economy, fantastic universities and schools, frequent festivals and sporting events are just but a few good qualities that make Virgina the perfect area for people to call home.
