The land that developed to become the modern-day state of Massachusetts was originally inhabited by Native American tribes who spoke the Algonquian language. These tribes included; the Wampanoag, Massachusett, Nipmuc, Mahican, Pocomtuc and the Narragansett. These tribes engaged in various economic activities such as hunting, fishing, gathering and farming of crops such as corn and squash.

The area was originally known as the Province of Massachusetts and was chartered in 1692. When buying or selling a house here, the real estate closing agent will typically use a Warranty Deed or Quit Claim Deed to convey the title of the property to the new owner. For the deed to be legally valid, the document must include the property’s exact legal description, which usually comes from language within the property’s original survey. This state primarily follows the Public Land Survey System (PLSS) methodology when surveying the properties. Since this state used to be part of the original 13 U.S. Colonies, it primarily follows the old English real estate surveying method of using Metes and Bounds to legally describe the property.

If you aren’t paying cash for the home and are instead getting a loan to buy the real estate, then understand that this is primarily a title theory state. This simply means that the raw title of the property will remain in a trust until the lien is ultimately paid off. The most common document that is used here to secure the lender’s interest in the title is called a Mortgage.

If for some reason the borrower cannot repay the home loan, then the lender can typically avoid having to go through the court system. They do this by merely starting a non-judicial foreclosure which typically only takes about 75 days to complete. However, when necessary, the lender may need to instead go to court and start a more lengthy and costly judicial foreclosure. The laws that pertain to the Mass. foreclosure process are mostly found in MA Statutes Chapter 244.

However, if you are a landlord that needs to evict a non-paying tenant, then you would need to reference the Mass. statutes of Part II, Title I, Chapter 186 instead. Whereas if you are looking to become a real estate agent, then you would just deal directly with the MA Real Estate Board, which oversees all the licensing of the agents and most of the implementation and enforcement of the Mass. Real Estate Laws. Amongst other things, the main requirements to get a real estate license here would be to be at least 18 years old, complete at least 24 hours of approved MA real estate courses, successfully pass the written state exam, pass certain criminal background checks, be sponsored by a licensed Mass. real estate broker, and pay the various required licensing fees.

The favorable business environment, the sporting action, rich heritage and the attractive sceneries are just a few of the many reasons why so many Bay Staters love to call the state home.
